 [2026] HKFC 17 has brought long-running ancillary relief proceedings in this case to a conclusion. In its judgment, the Family Court analysed various principles that are of general application. In so doing, the Court rejected the wife’s case as to compensation and conduct. As to contributions, the Court not only reaffirmed that a party’s earning capacity is not capable of being a matrimonial asset to which the sharing principle applies or in which a spouse is entitled to share, but also endorsed the guidance provided by the UK Supreme Court in 

[2025] UKSC 26 in respect of matrimonial property and non-matrimonial property. In the event, the Court considered that the husband’s open proposal was fair and made an order accordingly.
