HK45 is an organisation for young arbitration professionals in Hong Kong and beyond.

With thanks to HK45 for the kind invitation, 

 recently took part in its Annual Update 2025 at a panel discussion along with fellow guest speakers Amy Wei from CMS, Cameron Sim from Debevoise & Plimpton, and Stephanie Siu from Thomson Reuters.

Val’s topic—the intersection of arbitration and insolvency—explored recent cases and the different judicial approaches shaping this intricate field.

During the session, Val delved into two judicial approaches – the traditional and Salford/Lasmos approaches – sharing a range of insights while discussing notable cases such as 

The session's key takeaways are as follows: The Salford/Lasmos approach prevails in HK for the time being. Legal advisors must bear in mind the need for a holistic view when advising their clients on the court’s multifactorial approach where the petition debt is covered by an arbitration agreement, and should actively consider alternative remedies which may help to protect client’s position, e.g. Interim measures/injunctions in aid of arbitration.
