KONE Elevator (HK) Ltd v Construction Industry Council

 [2026] HKCA 115, the Court of Appeal addressed the first appeal in Hong Kong under s.57 of the Construction Industry Council Ordinance (Cap 587) (CICO).

The Appellant (KONE), a key player in the lift and escalator industry, contended that maintenance services, while a form of electrical and mechanical (E&M) works, are not “construction operations” under CICO Schedule 1 so as to be leviable. On

KONE’s case, no levy is payable on lift and escalator maintenance services across Hong Kong – a territory with over 80,000 lifts and escalators under regular maintenance.
